Terms and Conditions

The signing of an Agreement

Before commencing any project, it’s essential to understand the terms and conditions that govern our collaboration.

These Highlighted Terms outline important aspects of our working relationship, covering project urgency, timelines, revisions, payment terms, and more.

By familiarizing yourself with these terms, we can ensure a smooth and transparent process as we bring your vision to life.
01.

Intellectual
Property Rights

Upon project completion, the initial agreement does not grant clients rights to use, modify, or replicate any preliminary ideas, sketches, or visuals. All original materials remain the property of LuisFaus Artisans’ Atelier.

Display
& Attribution

Unless otherwise arranged, LuisFaus Artisans’ Atelier reserves the right to showcase finished designs in portfolios and online galleries. Designs may be signed and linked to the atelier’s website.

Future Use
of Unused Ideas

Unused concepts may be repurposed for future projects. If a similar design is retained, it will be sufficiently modified to avoid conflict.

04.

Commercial Use
& Artwork

Clients may utilize associated designs for commercial purposes. Supporting artwork can be used at the discretion of LuisFaus Artisans’ Atelier.

05.

Design
Iterations Limit

Upon selecting a design direction, clients are allotted a maximum of 5 iterations per design within any category. Exceeding this limit incurs an extra charge of $40 USD per new iteration, ensuring efficient project progression while accommodating additional revisions beyond the initial scope.

Trademarking and Copyrighting

The client holds sole responsibility for trademarking and copyrighting designs.

Financial
Responsibilities

Clients are responsible for covering any associated bank charges, tax deductions, or PayPal transfer fees incurred during payment transactions.

09.

Additional Work and Agreements

Any additional work requires a separate agreement and payment beyond the initial cost.

07.

Client's Freedom
to Modify

Clients have the freedom to adapt finished designs but do so at their own risk.

10.

Extra Work
Timelines

If projects extend beyond the initial scope, clients must provide extra time for completion.

11.

Third-Party
Content Usage

If third-party content is used (iStock, Envato, Creative Market, etc) clients must cover the licensing costs.

Feedback
and Finalization

Clients must provide timely feedback for the project’s completion. Final designs are approved upon client acceptance.

12.

Ownership Rights
Upon Full Payment

Until full payment is received, clients do not acquire rights or ownership of designs.

15.

Originality
and Confidentiality

LuisFaus Artisans’ Atelier guarantees the originality of work and ensures confidentiality of client information.

13.

Client Content
Rights

Clients must own or have rights to use all provided content.

16.

Payment
Terms

Payment is due in two installments: 50% upon signing the agreement and the remaining 50% before final file delivery.

17.

Cancellation
Clause

In the event of project cancellation by the client after work has commenced, a cancellation fee will apply. This fee will be determined based on the amount of work completed up to the cancellation date, with a minimum fee equal to $300 USD.

18.

Independent Contractor Status

LuisFaus Artisans’ Atelier operates as an independent contractor and not as an employee of the client.

19.

Entire Agreement
Clause

The agreement constitutes the complete understanding between both parties and supersedes any prior agreements.
